Terms of Service

1. Acceptance of Terms

By accessing or using SmartEA ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Platform. SmartEA reserves the right to modify these terms at any time, and your continued use constitutes acceptance of any changes.

2. Description of Service

SmartEA provides an automated copy trading platform that connects users' MetaTrader 5 (MT5) accounts with Expert Advisors (EAs). The Platform facilitates the automatic execution of trades based on signals generated by selected EAs.

3. Eligibility

You must be at least 18 years old and legally permitted to trade financial instruments in your jurisdiction. You are responsible for ensuring that your use of the Platform complies with all applicable local laws and regulations.

4. Account Registration

  • You must provide accurate and complete information during registration.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activities that occur under your account.
  • You must notify SmartEA immediately of any unauthorized use of your account.

5. MT5 Account Credentials

When connecting your MT5 account, you provide your broker account credentials to enable automated trading. These credentials are encrypted using AES-256-GCM encryption and stored securely. SmartEA uses these credentials solely for the purpose of executing trades on your behalf as directed by the selected EA.

6. Fees and Payment

SmartEA operates on a profit-sharing model. A commission of 15% is charged on net profits generated through copy trading. No fees are charged if no profit is generated. Detailed fee information is provided before activating any copy trading subscription.

7. Risk Acknowledgment

Trading foreign exchange and CFDs involves substantial risk of loss and is not suitable for all investors. Past performance of any EA does not guarantee future results. You should not invest money that you cannot afford to lose. By using the Platform, you acknowledge and accept these risks.

8. Limitation of Liability

SmartEA shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use the Platform, including but not limited to trading losses, technical failures, or unauthorized access to your account.

9. Termination

SmartEA may suspend or terminate your account at any time for violation of these terms or for any other reason at its sole discretion. You may terminate your account at any time by contacting support. Upon termination, all active copy trading subscriptions will be deactivated.

10. Governing Law

These terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these terms shall be resolved through binding arbitration.
